21 January 2010 - Government Intervention and HYIPs

Hi guys! Today's topic addresses something interesting that I think will change the HYIP industry in the near future. (Ok, perhaps not that near in future, but someday it probably will..We never know =D )Yes, there have been speculations abound that governments around the globe are taking the issue of HYIPs and Ponzi schemes more seriously right now. "Ponzi scheme is a fraudulent investment operation that pays returns to separate investors from their own money or money paid by subsequent investors, rather than from any actual profit earned." -- Wikipedia. But how and when will government interfere with these investment programs?

First and foremost, we need to take a good look at a notorious program that had collapsed due to government intervention. It was called
AdSurfDaily, or more commonly known as ASD. At that period of time, when ponzi schemes were not as widely known as it is right now (all thanks to Bernard Madoff =p) people were amazed, dazzled, and downright astounded at the earning capability ASD was introducing into the investment industry. It was not known how much money they were generating each day at their peak, but obviously just enough money to keep new investors coming and old investors satisfied because that's just the way HYIP rolls -- new, fresh funds to pay off the old funds. In fact, they were doing so well that everyone believed in the program and, as the payout frenzy went on smoothly for a few months, words of mouth started to spread, and everyone was talking about the new investment giant!

If they were doing so well, what could've gone wrong? For one thing,
ASD did not consider, or perhaps overlooked, the legitimacy issue of running a ponzi scheme.

For your information, ponzi scheme is not legal in any parts of the world, no matter how you term the program, or how you attempt to clarify the concepts involved. (Although it is possible that some governments use a system that is similar to ponzi in what it calls "social benefits". But I will not elaborate further on that as it will be out of topic.)

The collapse of
ASD was triggered by some college kids who obviously managed to profit from the system, and started propagating the news around campus. News of ASD reached the ears of one of the faculties (a law professor, in fact) and he contacted the FBI. One thing leads to another, FBI started investigation into the business, and KABOOMMM~~~~!!!! The whole business went bust, and people lost lots of money on that particular venture.



Enough of history class, now moving back into our modern context. Is government intervention still a relevant mention today? Or has
ASD awoken the sleeping dragons to the impending danger of ponzis?

I would like to suggest, and believe, that the government, especially FBI, have taken steps to curb these ponzi schemes. The single most significant and well-known example would be the arrest of Bernard Madoff, whose multi-billion corporation was based on nothing but lies. But that would be a different context now wouldn't it? Considering most of you guys who read this are either members of long-time HYIP giant,
GeniusFunds (I agree with many who say, "if you're going to invest in HYIPs, then why not invest in the best?" Indeed, GeniusFunds is the one program that's setting the bar for others), or something as recent as InvestJoy. How does government intervention affect these programs then?

Arbsfund, one of the those HYIP sites that propagated the concept of sports arbitrage, a relatively intriguing investing concept that was most likely popularized by GoldNuggetInvest, another HYIP program that's based on sports arbitrage. Well, it doesn't matter how interesting or promising Arbsfund looked, because it's over already. The program collapsed about a week ago. And that's the way the world turns. I wonder if anyone has speculated the reason for collapse?

As you can see, Arbsfund is not registered in Belize. In fact, a certificate of corporation can be obtained easily. For a small fee, you can get a really beautiful-looking certificate, with a seal from the government certifying your corporation as well. But, does that mean anything? Does a certificate guarantee that your funds are safe? And that in the event the company collapses, can you file for a refund? The answer is a big, resounding no.

It is still unknown what happened to
Arbsfund, but my guess would be they have simply ran out of funds. But maybe, just maybe, the government of Belize has started cracking down on ponzi schemes, and Arbsfund was one of the targets. Nonetheless, I would expect at least a notification from the government stating the case. So far, no news from anyone at all.

I've heard numerous times from several members on forums who suggest that the HYIP industry needs to be regulated, needs to be under stricter control, needs to be this, needs to be that etc..How do you think the HYIP industry
can be controlled? It is, first of all, an international industry, with no boundaries and no clear-cut lines that define which program is under the jurisdiction of which nation. Of course, you can counter-argue that these nations can cooperate. I'd say look at the number of international crime rings we have in the world right now, is it safe to say if all the nations cooperate then the world will be rid of these thieves, these con artists? That's something worth pondering, but in essence, HYIPs and ponzis are still just that -- HYIPs and ponzis. You never know what to expect from them, and no matter how lucrative and alluring the claims are, please do not let greed cloud your mind.

The only real intervention here is your mind. Instead of relying on government to regulate these HYIPs, why not just settle on handling and controlling that mind of yours, prevent yourself from investing all your principal and profits into a single program, hoping that they will pay you at the end of the term? Isn't that a much safer and more reliable way of preventing scams?

InvestJoy has sent out a newsletter informing members of the reason for delay in payouts. Although I want to stop myself from speculating, but it seems the funds are drying out fast in InvestJoy due to the fact that a big number of investors joined in the 150% after 15 days plan. It'll be interesting to see how long InvestJoy will survive, and will it weather through this crisis, especially with the launch of the new program, InvestBro. And the admin specifically mentioned that he will not invest too heavily on advertisement this time, as he hopes, and I hope he's right, that InvestJoy has brought enough attention to itself already, and that this wave of attention will carry on to InvestBro as well. Due this I will apply a rule during withdrawals from today until Monday, if you withdrew funds from a deposit made in the 150% after 15 days plan I will send your funds back to your account balance. In this moment I really cannot process your withdrawal because funds are in the investment portfolio. I'm working hard to have funds available on this Monday, so please if you have a withdrawal pending from 150% after 15 days plan contact to choose one of the both options below:

1) Invest the funds in the 5% daily for 30 days plan (you can do it yourself once funds will be available in your Member Area).

2) Invest the funds in the new program, InvestBro. It offers three plans. Plan A: 115% after 10 days, Plan B: 140% after 20 days, Plan C: 180% after 30 days.

This rule is valid only for members that made deposit in the old plan 150% after 15 days. If you deposited in the 5% daily for 30 days plan your withdrawals will be accomplished normally without delays. Payments will start again at 22:00 GMT as usual.

Please understand this measure is necessary because I really need few days to generate the returns and send funds back to our e-currencies. Sorry for any inconvenience it may cause to you. I've been paid by
GouldsInvest within minutes today, and I'm back in with a $30 spend. The funds seem to be flowing nicely, and I'm looking forward to another successful cycle with them =D

CedexInvest has been down on my side for a few days now, nonetheless, as I see many people are still getting paid, I assume that it's just my server that's causing the trouble. Hopefully I can log on soon and pull out my profit.

Underwatersurf's admin, Admiral Smalls has posted an update on various forums concerning issues about withdrawals. Apparently, some members keep sending in support tickets for their withdrawal, and the admin wants to let the members know that the withdrawal button is available in their back office. So far, I've been pulling out my money successfully, and payouts are being made promptly as well. The other admin, Captain Carlos is on an emergency family trip, and he'll be back probably tonight or tomorrow. Here's the update:

I feel that I have to cover a point here that is very important. I know most of you know how this works. But, I need to post this for members that do not know how this works. I am posting this as we keep getting payout requests not from the some of the members accounts, but from people submitting support tickets with an amount & their account numbers. We get emails all day long even from people that are not members asking for payout requests.

Payouts are not done this this way. If you have an account with us and you are a member you need to go into your members area and request a payment using the withdrawal option. When you do that it will show up in our account manager as soon as you do that. If you do not do a withdrawal request in your members account then it will not show up in the account manager. We test this daily to make all is working properly and it is working!

Also we process payments for that day only. As an example if your payment is due on the 21st which is today your payment will be processed on the 21st usually within 5min-2hrs of your request and we process the payment of the day all day as they come in. If you request your 22nd of January payment after you surf on the 21st you will not be paid until the day it is due which is the 22nd.

As always, it's almost Friday again. And this usually means payout time for SazaInvestment members. But today, due to some auditing problems, the admin announced earlier that the button was disabled. As of writing, the button is still disabled. Here's the newsletter:
